Bicycle Accidents

Advocating for Bicycle Accident Victims

The road can be a dangerous place for bicycle riders. Careless and distracted drivers frequently cause serious and sometimes fatal bicycle accidents. Unfortunately, the challenges don’t end there—insurance companies and courtrooms can be just as hazardous. Insurance adjusters work hard to deny claims or minimize payouts, and bicycle riders often face anti-cyclist bias from police officers and juries, leading to unfair blame for accidents that were not their fault.

Given these challenges, it’s crucial to talk with an experienced bicycle accident attorney as soon as possible. Rubio Law Firm is dedicated to protecting the rights of injured cyclists.

Steps to Take After a Bicycle Accident

  1. Seek Medical Attention: Your health is the top priority. Get medical help immediately.
  2. Document the Scene: If possible, take photos of the accident scene, your injuries, and any damage to your bicycle.
  3. Gather Information: Collect contact and insurance details from all parties involved, as well as contact information for any witnesses.
  4. Contact Rubio Law Firm: Early legal advice can significantly impact your case’s outcome.

In cases where a collision between a car and a bicycle happens, it is imperative to preserve any available Electronic Data Recorder (“EDR”), commonly known as a Black Box, from the car involved. A lawyer needs to send a preservation letter, asking the owner of the car to preserve the EDR. An expert is then needed to conduct the download of the EDR. Rubio Law Firm is experienced with this process. An EDR can reveal the speed of the car and whether a signal light was activated prior to the wreck. Since accidents often happen when cars fail to notice a bicycle, it’s crucial to find out if the driver of the car activated its signal light prior to moving lanes or passing a bicycle.

Motorcycle Accidents

Advocating for Motorcycle Wreck Victims

Motorcycle accidents often occur due to the negligence of car drivers, yet victims frequently struggle to obtain fair compensation. Challenges such as insufficient evidence, limited insurance coverage, and biases against motorcyclists can complicate these cases. Rubio Law Firm is committed to helping injured bikers overcome these obstacles and secure the compensation they deserve.

Unique Risks of Motorcycle Accidents

Motorcycles are convenient and enjoyable but come with higher risks. Motorcyclists are more vulnerable to serious injuries due to the lack of protection compared to car drivers. Common causes of motorcycle wrecks include:

  • Driver Negligence: Car drivers often fail to notice or yield to motorcyclists.
  • Road Hazards: Potholes and debris pose greater dangers to motorcycles.
  • Weather Conditions: Adverse weather can increase accident risks.

Why Legal Representation Matters

After a motorcycle wreck, hiring a personal injury lawyer may not be your first thought, but it is crucial. An experienced attorney can gather evidence, negotiate with insurance companies, and advocate for you in court if needed. At Rubio Law Firm, we prioritize the rights of injured motorcyclists, using evidence-based strategies to counter biases and ensure fair compensation.

Brain Injury

Advocating for Brain Injury Victims

Brain injuries can profoundly alter lives, making everyday activities challenging. When these injuries are caused by someone else’s negligence or reckless behavior, victims deserve answers and fair compensation.

Brain injuries often result in cognitive, emotional, and physical impairments that disrupt work, study, and daily life. The financial impact can be severe, with medical bills, rehabilitation costs, and lost wages adding to the burden. Rubio Law Firm’s mission is to help victims navigate their cases and secure the justice they deserve.

Understanding the Impact of Brain Injuries

Awareness of the devastating effects of brain injuries has increased in recent years, partly due to high-profile cases involving NFL players and military personnel. However, it’s important to recognize that brain injuries can affect anyone, anywhere. Whether it’s a car accident on a busy highway, a slip and fall in a public place, or a sports-related injury, the consequences are often severe and life-changing.

Brain injuries can occur in numerous scenarios:

  • Car Accidents: High-speed collisions or even minor fender benders can result in traumatic brain injuries, with symptoms that might not manifest immediately.
  • Slips and Falls: A simple trip or slip can lead to a serious head injury, especially in crowded or busy areas.
  • Sports Injuries: Children and adults alike are at risk of brain injuries during sports activities, particularly if proper safety protocols are not followed.

Even when there is not a direct hit between the head and an object, a brain injury can occur. The mere rapid movement of the head, followed by a sudden stop of the head can cause the brain to hit or be pressed against the head cavity, causing an injury to the brain.

Wage and Overtime

All employees have the right to be free from compensation discrimination according to United States law. Equal pay requires that people, regardless of sex, receive equal pay for equal work in the same establishment. It is not necessary that the work is the exact same, but that it is substantially the same.

This means that the activities performed are similar or complementary, regardless of the title of the position.

Companies cannot pay different wages based on differences in sex, creed, nationality or any other difference. As long as the work requires the same skill, effort, time and responsibility, compensation should be equal.

In the state of Alabama, minimum wage is set at $7.25/hour by law. If an employee works more than 40 hours in a week, the employee must be paid “overtime” for each additional hour worked. Overtime is 1.5 times the hourly wage.

ConceptHours Worked in a WeekHourly WageOvertime Wage
Worker 140 hours$7.25$0.00
Worker 240 hours/ 3 hr.s = 45$7.25$10.87
Worker 340 hours/ 8 hr.s$12.00$18.00
Worker 440 hours/ 5 hr.s = 45$10.00$15.00

There are three types of employees that this law does not apply:

  1. Members of the company management
  2. Employee receiving tips at work
  3. Agricultural employee

Companies are not allowed to pay you a fixed amount per week unless you are employed as a manager. You can assert your rights regardless of your immigration status, since immigration status does not prevent you from making a claim.

If you have been discriminated against at work or have not been paid extra time, contact us for a free consultation. We put our experience at your disposal to assert your rights.

Work Accidents

Every year, thousands of people in the United States become incapacitated while performing their jobs because of falls, accidents with heavy machinery, or excessive efforts.

Employers must have safety measures in place to ensure the employees’ well-being. The law protects all working people, regardless of immigration status, social security status or work permit.

It is considered an accident at work when an employee is injured while at work, and can be generally classified as either a Minor Work Accident or a Severe Work Accident:

Minor Work Accidents

  • Cuts
  • Falls
  • Collision (shock)
  • Falling of objects somewhere in the body
  • Burns
  • Sprains
  • Stings
  • Falling of objects in the eyes
  • Others

Severe Work Accidents

  • Amputation of a member
  • Require rescue team assistance (ambulance)
  • Loss of consciousness
  • Need resuscitation
  • Death

Injuries can be temporary or permanent. If you received an injury due to negligence of your employer, you could be entitled to compensation.

Accidents with Drunk Drivers

Driving under the influence of alcohol or drugs increases the chances of crashing into another automobile, object, or person. In many cases, driving under the influence results in very serious injuries or even death. Because of these facts, US laws penalize driving while under the influence of alcohol or drugs.

It is always unfortunate when someone is injured or killed in an accident caused by an intoxicated driver. If you or one of your loved ones are seriously injured by an intoxicated driver, it is very important to immediately contact our lawyers since crucial evidence is often lost within hours after the accident. We are prepared to come to you to preserve the evidence, examine the place of the accident, examine the vehicles, and examine everything else necessary to fight for you.

In many cases, the bars and restaurants that serve alcoholic beverages to visually intoxicated people may also be responsible for someone driving in a state of drunkenness, and they should also take responsibility for the damages.

We put our experience at your disposal and assert your rights. Call us as soon as possible after the accident.

Defective Products

Protecting Consumers from Dangerous Products

When you use or purchase a product, you expect it to be safe for use. Unfortunately, defective products can cause serious injuries, leaving victims with medical expenses, lost wages, and long-term suffering. At Rubio Law Firm, we help individuals who have been harmed by dangerous or faulty products who seek justice and compensation.

Many employees use defective machines or products at work. So in addition to a workers’ compensation case, the injured employee may also have a case against the manufacturer of the defective machine or defective product that caused the injury to the employee.

Understanding Defective Product Claims

Defective product cases fall under product liability law, which holds manufacturers, designers, and sellers responsible for unsafe products. A product may be considered defective due to:

  • Design Defects – Flaws in the product’s design make it inherently dangerous, even when used correctly. For example, a machine without a safety guard.
  • Manufacturing Defects – Errors in production cause a product to become unsafe, even if the design is sound. For example, a car tire that was not properly made.
  • Failure to Warn – Lack of proper instructions or warning labels can lead to serious injuries. For example, a machine that fails to warn of pinch points.

Common Types of Defective Products

Defective products can be found in almost every industry, but some of the most common cases involve:

  • Defective Auto Parts – Faulty brakes, airbag malfunctions, and tire defects can lead to catastrophic accidents.
  • Dangerous Medications & Medical Devices – Some prescription drugs and medical implants may cause severe health complications.
  • Household Appliances & Electronics – Faulty wiring, fire hazards, or poorly made appliances can cause harm to consumers.
  • Children’s Toys & Products – Unsafe toys or baby products with choking hazards and toxic materials put children at risk.
  • Industrial & Construction Equipment – Defective tools and machinery can result in serious workplace injuries.

Who Is Responsible for a Defective Product?

Liability in defective product cases may fall on multiple parties, including:

  • Manufacturers – If a company produces a faulty product, they may be held accountable for injuries it causes.
  • Retailers & Distributors – Businesses that sell or distribute dangerous products can also be liable.
  • Designers – If a product is dangerous due to its design, the original creator may be responsible.

Seeking Compensation for Your Injuries

If you or a loved one has been injured by a defective product, you may be entitled to compensation for:

  • Medical bills and future medical expenses
  • Lost wages and reduced earning capacity
  • Pain and suffering and mental anguish
  • Property damage
  • Long-term rehabilitation and care

What to do if you suffer injuries from a defective product

After an injury your most important concern should be your health. After seeking medical treatment, consult with an experienced lawyer. A lawyer can send a Preservation Letter asking the entity or person with control to preserve the product, machine or device that caused the injury. It is vital to the case that the product, machine or device be preserved so that it can be inspected, examined and even tested.
